The High Court has upheld a ruling ordering Villa Air to pay six months’ salary as compensation to an employee dismissed over sexual harassment allegations, citing a lack of evidence and failure to follow due process.
The dispute stems from the dismissal of a Ground Operations Assistant at Villa Air on March 8, 2023, following allegations of harassing a female coworker. The employee subsequently challenged the termination at the Employment Tribunal.
In its judgment, the High Court sustained the tribunal’s decision directing Villa Air to compensate the former worker at a rate of MVR 10,200 per month for six months.
The court noted that Villa Air’s internal investigation report failed to provide sufficient evidence or proof to establish sexual harassment under civil standards. Furthermore, the High Court determined that Villa Air breached procedural and substantive fairness when terminating the employee’s contract.
